Managing property in India from abroad comes with legal and financial complexities most NRIs discover only after it becomes a costly problem. Read this section carefully β it could save you lakhs of rupees.
Under Section 195 of the Income Tax Act, any tenant paying rent to an NRI landlord must deduct 30% TDS before making payment. This is the tenant's legal obligation β but if they fail to deduct it, the NRI landlord is personally liable for the full TDS amount, plus 1.5% monthly interest, plus potential prosecution. Most tenants in India are either unaware of this law or simply do not follow it. Your CA or tax adviser in India may not proactively flag this either.
A General Power of Attorney (GPA) gives another person broad authority over all your assets β this is extremely risky and is the most common vehicle for NRI property fraud in India. NRE accounts are for foreign income remitted to India, not Indian-earned income. Depositing Indian rental income into an NRE account is a FEMA violation. From your NRO account, you can repatriate up to USD 1 million per financial year overseas, subject to tax compliance and CA certification through Form 15CA and 15CB.
When repatriating rental income from your Indian NRO account to your overseas bank account, Indian banks require two mandatory documents: Form 15CA β an online declaration by the remitter confirming all applicable taxes have been paid β and Form 15CB β a certificate from a practicing Chartered Accountant confirming tax compliance. Without both documents, no Indian bank will process your international transfer regardless of the amount. Your money stays locked in India until these are submitted.
